Ways to Secure Your Business Against Legal Action & Financial Loss

  • Written by News Company

Your business is your livelihood; as such, you need to do everything you can to protect it. There are many people out there who wish to ruin someone, or through no fault of the business they end up getting sued for alleged wrongdoing.

But what happens if you are not insured or don't have safety measures in place for your business? If you are a business owner and you have not taken steps to protect your business from legal action, then read on to learn six great ways you can do this.

1. Draft legal contracts

With a legal contract, you have a binding agreement between two parties that allows everyone involved proper legal recourse if an accident or some other incident should occur. With contracts, there is a clear set of guidelines which will protect your business legally as well as your dealings with the other party or parties as the case may be.

2. Keep accurate records

Without accurate records, you run the risk of being sued for something you did not do or getting in trouble with the taxman for not keeping accurate books. This is also a good backup measure for any disgruntled customers who might wish to challenge you and say you did not do work for them or they were not paid if they were working for you, etcetera.

3. Make sure you have insurance

Make sure you have professional indemnity insurance among other insurances. With insurance, you have a backup plan if things go south and you have the policy to draw from if you get into trouble. So many businesses fail to see the benefits of insurance and opt to ride solo. These are the businesses that fold due to unforeseen legal trouble.

4. Incorporate your business

Incorporation is a very good idea. When you incorporate a business, it separates your finances from the businesses finances and allows you to protect you & your family from unforeseen lawsuits. If your company is sued, the person suing you can only go after assets owned by the business and not the individual.

5. Have a company policy and stick to it

Many people roll their eyes when they think about corporate responsibility or company policies and how they tend to chop and change, or people will interpret them in one way or the other but having company policies is paramount to running an active business and protecting yourself from lawsuits.

If everyone is on the same page & have similar business perspective, then you will have a better chance of protecting your overall business. Now your business might be small today, but you could grow into a conglomerate and as you will have a greater understanding of company policy and how it should be applied for best practices.

6. Have a lawyer on tap

Yes, lawyers are expensive, but they are 110% necessary. In having a lawyer, especially hiring one in the early days of your company, you would have unprecedented access to a professional who can advise you on what not to do to avoid being sued. Moreover, they can help you with online mediation and contract law and help you set up the company guidelines to align with the law and labour rules.

The Takeaway

It is 110% necessary to protect yourself and your business from being sued, and with the ideas aforementioned you too can find the peace and security you need to run your business free from the worry of legal troubles. Give yourself some peace of mind & do the right thing for your business as well as yourself.
